Our website grants you a non-exclusive limited license to use the WordPress® themes, plugins and other Products sold through our website (http://www.primothemes.com/) by PriMoThemes (the "Products") in accordance with these Terms & Conditions (the "License") issued by PriMoThemes, and our parent company, WebSharks, Inc. (the "Company").
Product Licensing & Usage Guidelines
WordPress® / GNU GPLv3 Licensing
All of our Products are licensed under the terms of the GNU GPLv3 (General Public License). Our Products may be used by our Customers, for personal and/or commercial use, on as many websites as they like. As a Customer, you are free to modify and adapt them to fit your purposes, or for the purposes of your clients. All source files are included ( PSD or FLA files, PNGs, PHP Code, JavaScript, jQuery extensions, etc. ). Developers can also use our Products, including their source files, on client projects.
Two Different Membership Levels
Basic Membership ( 30 day membership, NOT-recurring )
Basic Membership is NOT associated with any recurring charges. With a Basic Membership you'll have 30 days to download any two Products you like. Both personal & commercial usage are allowed. You're paying $75 for the first Product, and getting the second one absolutely free! You'll have 30 days to browse our entire Product selection and decide which two Products you want most. You're free to use them on as many websites as you need to.Basic Membership does NOT include unlimited downloads, and it does NOT include ongoing access to support-related services; such as software updates, improvements, change logs, or advanced customization tips. If you need ongoing access to the latest software updates & other support-related services, you'll need to upgrade to a Premium Membership.
Premium Membership ( unlimited downloads + updates + 3 new Products monthly )
Premium Membership comes with UNLIMITED downloads ( unlimited access ) for 30 days; which allows you to download as many Products as you like, and use each of those Products on as many personal and/or commercial sites as you need to, for as long as you need to. If you choose to remain a Premium Member, you may continue your membership for just $25/month. While you're a Premium Member, you'll receive at least three newly released Products each month, and you'll have full access to all software updates & other support-related services.Please take note that your Premium Membership will be automatically renewed at the end of your subscription period, via PayPal®. If you wish to cancel your subscription, you'll need to log into your PayPal® account & deactivate your subscription. Or, you may contact support at least 7 days prior to the end of your subscription, requesting such a cancellation. No exceptions will be made in this regard. If your Premium Membership is automatically renewed, we will assume that we've done so with your express permission.
Gaining Access To Download Products
The Subscription Registration Process ( powered by PayPal® )
Access to download our Products is provided instantly ( immediately ) after you've paid for your Membership via PayPal®. Upon returning from PayPal®, you'll be given the opportunity to register a Username & Password. We will also send an email to your PayPal® email address, with a link to the registration page, just in case you missed something. After paying for your Membership, and registering your Username & Password; you may log into the site and begin downloading Products. * Note: No invoices will be made available for your purchases/subscriptions, as the PayPal® sales receipt is deemed to be sufficient financial information.
Updates, Security Patches & Compatibility
Future-Proofing / Software Compatibility With WordPress®
All of our Products are designed to be compatible with the latest available version of WordPress®. We also make every effort to future-proof our Products, in a variety of ways, so they'll remain compatible in future versions of WordPress® as well. Of course, there are exceptions, and we're not perfect. We can give no guarantee that all Products will remain functional in future versions of WordPress®. If something major changes in a new version of WordPress®, and updates or improvements are needed, they will be made available on our website. Premium Members will receive these updates & improvements ( as needed ) while their subscription remains active.
In some cases, where a particular Product has become extremely outdated, or we decide there is no feasible workaround available to us, we may choose to discontinue that particular Product, and instead, work to produce an entirely new version that takes advantage of the latest improvements in the most recent version of WordPress®.
Cross-Browser Compatibility / W3C Standards Compliance
Our Products support all modern web browsers (PC & Mac) including (but not limited to) Firefox®, Safari, Google® Chrome, Opera & Internet Explorer. While we strive to give every Product a seamless & near-identical experience across each of these browsers, it is impossible to compensate for the lack of web standards support (relating to XHTML & CSS) in some of these browsers; particularly with Internet Explorer. In the case of a browser ( or a particular version ) not supporting certain web standards, we will include a generic workaround for that browser ( when possible ), which will degrade a specific function/feature gradually, and in a way that doesn’t affect the user experience negatively. Other Applicable Terms & Conditions
Ownership / Intellectual Property Rights
You may not claim intellectual or exclusive ownership over any of our products, modified or unmodified. All products are property of PriMoThemes ( WebSharks, Inc. ). Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall PriMoThemes be liable for any damages, including, but not limited to, direct, indirect, special, incidental or consequential damages, or other losses arising out of the use of, or inability to use our products.
Digital Goods ( No Refund Policy )
Since PriMoThemes is offering non-tangible, irrevocable, digital goods; we do NOT issue refunds, which you are responsible for understanding. Although Basic Membership is NOT recurring, please take note that Premium Membership DOES automatically renew ( $25/month ) at the end of your subscription period, via PayPal®. If you wish to cancel a Premium Membership subscription, you'll need to log into your PayPal® account & deactivate your subscription. Or, you may contact support at least 7 days prior to the end of your subscription, requesting such a cancellation. No exceptions will be made in this regard. If your Premium Membership is automatically renewed, we will assume that we've done so with your express permission. No refunds whatsoever will be given in this regard.
Our Customer Service & Support Policy
PriMoThemes offers its Products "as is", with no implied warranty or guarantee that they will function exactly as you wish, or with all 3rd party components and plugins. Further, we offer no support via email, or otherwise, for installation, customization, or administration of WordPress® itself. We only cover support for our own Products, and we can’t give general WordPress® support that isn’t related to our Products. For general WordPress® support you will have to use the WordPress® Codex.
Prices Are Subject To Change
PriMoThemes reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, a subscription (or any part thereof) with or without notice. Prices of all subscriptions and products, including, but not limited to monthly subscription fees, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the PriMoThemes website.
Warranty / Guarantee
PriMoThemes does not warranty or guarantee our Products in any manner. We cannot guarantee they will function with all 3rd party components, plugins or web browsers. Browser compatibility should be tested against the demonstrations available on our development server, with links being made available on Product pages. Please ensure that the browsers you use will work with the Products you desire, as we can not guarantee that our Products will work with all browser combinations.
Future Modifications / Policy Changes
( Our Company reserves the right to change or modify the current Terms & Conditions with no prior notice. )
